The Fair Work Act 2009 (Cth) (Fair Work Act) allows trade unions to apply to the Fair Work Commission (FWC) for them to be covered by a company agreement. If the majority of workers wish to negotiate with their employer in a workplace, the employer must negotiate with them in accordance with the provisions of the law. An agreement is reached when a majority of the staff concerned vote in favour of a valid agreement.
